HOPPERS PLUMBING | TERMS & CONDITIONS
TERMS & CONDITIONS:
HOPPER’S PLUMBING TERMS AND CONDITIONS OF SERVICE
Effective Date: September 29, 2026
Location: Placer County, California
CSLB License No. 872354
BY ELECTRONICALLY SIGNING OR APPROVING ANY ESTIMATE, CONTRACT, WORK ORDER, CHANGE ORDER, OR OTHER SERVICE AUTHORIZATION THROUGH HOUSECALL PRO, THE CUSTOMER ACKNOWLEDGES THAT THEY HAVE RECEIVED, READ, UNDERSTAND, AND AGREE TO THESE TERMS AND CONDITIONS AS APPLICABLE TO THE AUTHORIZED WORK.
These Terms and Conditions supplement the specific estimate, contract, work order, change order, invoice, and any notices or disclosures required by California law. When California law requires a specific Home Improvement Contract, Service and Repair Contract, Notice of Cancellation, Mechanics Lien Warning, or other statutory document or disclosure, the applicable project-specific document and statutory requirements control.
1. PARTIES, CUSTOMER AUTHORITY AND ELECTRONIC ACCEPTANCE
This Agreement is entered into by and between Hopper’s Plumbing (“Contractor,” “Company,” “we,” “us,” or “our”) and the Customer (“Customer,” “Client,” “you,” or “your”) identified on the applicable Housecall Pro estimate, contract, invoice, or work order.
By electronically signing or approving the applicable document through Housecall Pro, Customer acknowledges having read, understood, and agreed to these Terms and Conditions and the approved scope and price.
Customer represents that Customer is the lawful property owner or is an authorized agent of the property owner with authority to approve the work and accept responsibility for payment.
The fact that a person is present at the property does not automatically mean that person has authority to approve work, changes, charges, or payment obligations. Hopper’s Plumbing may require confirmation from the property owner, property manager, responsible payer, or other authorized party before proceeding.
2. CUSTOMER COMMUNICATION
Customer acknowledges that electronic communications, including automated text messages, emails, digital estimates, invoices, secure portal messages, photographs, electronic signatures, and Housecall Pro communications, may be used for business communications, appointment notifications, job documentation, estimates, approvals, change orders, invoices, and payment records.
A technician’s verbal statement does not modify an approved written scope, price, contract, change order, or these Terms unless the change is properly documented and authorized.
3. AUTHORIZATION TO PERFORM WORK, ACCESS, UTILITIES AND PETS
Customer authorizes Hopper’s Plumbing to furnish the labor, materials, equipment, and services specifically described in the approved Housecall Pro estimate, contract, work order, or change order.
Customer agrees to provide safe, clear, unhindered, and reasonable access to all areas required for the authorized work, including crawlspaces, attics, main shutoff valves, cleanouts, meters, plumbing fixtures, mechanical areas, and exterior work areas.
The work area must be reasonably free of household clutter, debris, animal waste, pests, or other conditions that prevent safe access. Hopper’s Plumbing is not responsible for moving furniture, stored belongings, appliances, or other personal property unless specifically included in writing.
Pets must be safely secured away from the work area.
Customer must provide functioning on-site water and electrical utilities reasonably necessary to perform and test the authorized work unless otherwise agreed in writing.
If Hopper’s Plumbing arrives and cannot safely or reasonably access the work area or necessary utilities because of locked gates, Customer restrictions, unsecured animals, excessive debris, contamination, unavailable utilities, or another condition within Customer’s control, the applicable Standard Dispatch Fee, Standard Service Call, Trip Charge, or cancellation charge disclosed for the appointment may be applied and the work may be rescheduled.
4. ARRIVAL WINDOWS
Arrival windows are estimates and are not guaranteed appointment times.
Hopper’s Plumbing generally schedules two-hour arrival windows. Once a technician is actually traveling to the property, Housecall Pro or the technician may provide a more specific estimated arrival time.
Arrival times may change because of prior jobs requiring additional time, traffic, weather, supplier delays, safety conditions, emergencies, or other circumstances beyond Hopper’s Plumbing’s reasonable control.
Hopper’s Plumbing will communicate significant delays when reasonably practical.
5. FREE ESTIMATES AND BILLABLE DIAGNOSTIC SERVICE
A free estimate is limited to a walk-around and visual inspection of reasonably accessible conditions when the requested work can reasonably be priced without troubleshooting, testing, disassembly, or diagnostic investigation.
Use of a flashlight, tape measure, phone, camera, or similar item solely for visual observation, photographs, or measurements does not by itself convert a free estimate into a billable service call.
If determining the cause of a problem requires the technician to remove a tool bag from the vehicle, use diagnostic or testing equipment, troubleshoot, test operation, disassemble equipment or plumbing, locate a failure, investigate the cause of a condition, or otherwise perform diagnostic work, the visit becomes a billable service or diagnostic call.
Before beginning billable diagnostic or investigative work, the technician will explain that the requested work exceeds the free-estimate scope, provide the applicable service-call or diagnostic price, and obtain Customer authorization.
If Customer declines the diagnostic or service-call charge, Hopper’s Plumbing will not perform the diagnostic or investigative work and the technician may leave the property without charge for the declined free-estimate visit unless another previously disclosed charge properly applies.
6. PROPERTY CONDITION AND PRE-EXISTING CONDITIONS
Customer acknowledges that plumbing systems and surrounding structures age, corrode, deteriorate, weaken, and may be old, brittle, improperly installed, altered, previously repaired, or previously damaged.
Work performed by Hopper’s Plumbing may expose hidden defects or cause weakened pre-existing components to fail.
Hopper’s Plumbing is not responsible for failure, leakage, structural movement, deterioration, or damage involving pre-existing plumbing, piping, valves, fixtures, drains, walls, flooring, cabinetry, tile, concrete, roofing, landscaping, foundations, or other property components when reasonable care has been exercised, except to the extent responsibility cannot legally be excluded.
This includes, but is not limited to, damage or failure resulting from operating old main shutoff valves, angle stops, fixture shutoffs, or other valves that may freeze, leak, seize, or fail when operated working on corroded, degraded, brittle, or aged piping, including galvanized iron, polybutylene, degraded copper, or thin-walled plastic piping and drilling, cutting, fastening, or installing plumbing components into finished, brittle, deteriorated, or weakened surfaces.
7. WATER SHUTOFF AND SYSTEM RESTART RISK
Restoring main water pressure to an older or deteriorated property can cause sudden failure of existing components elsewhere in the plumbing system.
Hopper’s Plumbing is not responsible for leaks, pressure-related failures, sediment clogs, or failure of pre-existing plumbing caused by restoring water service when reasonable care has been exercised.
This includes, but is not limited to, spontaneous leaking or failure of pre-existing valves, fittings, aerators, pressure reducing valves, water heaters, toilet fill valves, angle stops, washing machine valves, refrigerator valves, ice maker lines, flexible connectors, or other existing components.
Hopper’s Plumbing will inspect accessible connections disturbed by its work but cannot guarantee unrelated existing plumbing throughout the property.
8. DRAIN CLEANING, CABLING, DESCALING AND HYDRO-JETTING DISCLAIMER
Drain cleaning, snaking, cabling, descaling, and hydro-jetting involve working inside piping that may already be cracked, root-intruded, corroded, offset, deteriorated, collapsed, or structurally unsound.
Mechanical cleaning and high-pressure water streams exert physical force and may expose or worsen existing pipe defects.
Piping that is already structurally compromised may break, collapse, puncture, disintegrate, or leak. Hopper’s Plumbing is not responsible for failure caused by pre-existing pipe defects, including deteriorated Orangeburg, rusted cast iron, cracked vitrified clay piping, damaged plastic piping, roots, offsets, bellies, or other structural deficiencies.
Stoppages may return immediately when structural defects, bellies, roots, foreign objects, grease, improper use, or other underlying conditions remain.
Because Hopper’s Plumbing cannot control what is introduced into a drain system after service, drain cleaning, hydro-jetting, snaking, cabling, and line-clearing services carry no warranty or guarantee against future stoppages unless a separate written warranty or permanent structural pipe repair or replacement is specifically included and purchased.
If a structural defect, root intrusion, collapsed pipe, obstruction, or other pre-existing condition causes a Company cable, camera head, hydro-jet nozzle, locator component, or other equipment to become trapped in the piping, any additional excavation, access, pipe repair, or other work necessary to retrieve the equipment is outside the original cleaning or diagnostic scope and may be separately chargeable.
9. SCOPE OF WORK, INCLUSIONS AND SPECIFIC EXCLUSIONS
Only work specifically described in writing on the approved Housecall Pro estimate, contract, work order, or change order is included.
All other work is excluded unless specifically added and approved in writing.
Unless expressly stated as included in the approved scope, Hopper’s Plumbing is not responsible for:
A. Permits, Placer County or other jurisdictional permit fees, plan check fees, or municipal inspections.
B. Finish materials, decorative fixtures, specialty trim, or custom finishes.
C. Demolition beyond what is reasonably necessary to physically access the plumbing work.
D. Drywall, sheetrock, plaster, texture, paint, wallpaper, or insulation repair or replacement.
E. Tile, stone, marble, or grout repair or replacement.
F. Flooring, subflooring, baseboards, hardwood, laminate, vinyl, or carpet repair or replacement.
G. Cabinets, countertops, vanities, shelving, or millwork repair, modification, or replacement.
H. Pipe painting or cosmetic pipe finishing.
I. Concrete cutting, concrete coring, saw cutting, concrete removal, concrete replacement, or concrete patching.
J. Asphalt, pavers, driveways, walkways, patios, or flatwork repair or replacement.
K. Roof penetrations, roof repairs, roof restoration, or roof flashing.
L. Stucco, siding, brick, masonry, or exterior wall finish repair or replacement.
M. Landscaping, sod, plants, trees, irrigation, or sprinkler systems.
N. Excavation spoil removal, hauling, disposal, or import of fill material unless specifically included.
O. Trenching, shoring, dewatering, or soil stabilization beyond the work specifically described in the approved scope.
P. Electrical work, low-voltage work, or other specialized trades.
Q. Gas line work unless specifically listed as an active approved line item.
R. Leak detection services, slab leak detection, hidden electronic tracing, or other leak-location services unless specifically listed.
S. Hazardous materials, including asbestos, lead, mold, PCB-containing material, contaminated soil, sewage contamination, biological contamination, chemicals, or animal waste.
T. Structural engineering, structural design, or structural repairs.
Tile and Wall Depth Responsibility: Plumbing rough-in is based on standard wall finish depth of approximately 1-1/4 inches unless otherwise specified. Hopper’s Plumbing is not responsible for extensions, modifications, fitment problems, or finish repairs required because the finished wall assembly is thicker than anticipated unless the condition was disclosed and included in writing before the rough-in work began.
10. EXCAVATION, TRENCHING AND UNDERGROUND WORK
Underground conditions are inherently unknown and may include rock, groundwater, buried debris, unstable soil, undocumented utilities, roots, abandoned piping, concrete, unsuitable soil, or other obstructions.
Additional labor, heavy equipment, materials, access work, excavation, dewatering, shoring, or additional time may be required at additional cost if subsurface obstructions or unforeseen underground conditions are encountered.
Surface restoration is excluded unless specifically itemized in the approved scope.
Hopper’s Plumbing is not responsible for damage to unmarked or undisclosed private utilities, invisible dog fences, landscape lighting, irrigation, private electrical lines, communication lines, underground structures, or deep root systems.
Hopper’s Plumbing is not responsible for normal or natural soil settlement following excavation and backfill or for failures occurring outside the immediate repair area unless caused by Hopper’s Plumbing’s workmanship.
11. WATER TREATMENT EQUIPMENT
For water treatment, filtration, conditioning, softening, reverse osmosis, and related equipment installed or serviced by Hopper’s Plumbing, Customer acknowledges that media life and equipment performance vary based on actual household water consumption and source-water conditions.
Water quality may change because of municipal treatment changes, seasonal well conditions, drought, groundwater variation, source-water chemistry, mineral concentration, or other conditions outside Hopper’s Plumbing’s control.
Water treatment systems require ongoing maintenance. Filter replacement, salt replenishment, chemical additions, cleaning, and other routine maintenance are Customer’s responsibility unless specifically included in a separate written maintenance agreement.
Hopper’s Plumbing does not guarantee that water treatment equipment will permanently eliminate or prevent fixture staining, scale accumulation, mineral deposits, localized odors, taste changes, or other aesthetic water conditions when underlying water chemistry changes.
Water treatment systems, filtration systems, softeners, reverse osmosis systems, specialty media, tanks, filters, and related equipment furnished specifically for a Customer are special-order and non-returnable equipment unless Hopper’s Plumbing confirms otherwise in writing.
Once Customer-authorized water treatment equipment has been ordered or installed, it may not be cancelled, returned, or refunded except where required by applicable law or expressly agreed in writing by Hopper’s Plumbing.
12. WELL SYSTEMS
When Hopper’s Plumbing performs diagnostic, repair, or installation services involving wells, pumps, pressure tanks, controllers, or related equipment, Customer acknowledges that well recovery rates and seasonal water levels fluctuate because of environmental conditions, drought, aquifer changes, groundwater conditions, and other circumstances outside Hopper’s Plumbing’s control.
Hopper’s Plumbing is not responsible for dry wells, reduced well yield, aquifer depletion, or naturally occurring groundwater changes.
Changes in mineral content, sand, silt, iron, sediment, or other water chemistry can affect equipment performance and pump longevity. Hopper’s Plumbing is not responsible for premature component wear caused by source-water quality or naturally occurring groundwater conditions.
Electrical supply variations, voltage fluctuations, lightning, or power surges may damage pumps, submerged motors, controllers, or control boxes. Hopper’s Plumbing is not responsible for electrical supply anomalies unless directly caused by Hopper’s Plumbing’s work.
Hopper’s Plumbing does not warrant or guarantee well production, recovery capacity, long-term water volume, future groundwater level, or long-term water quality.
13. EXISTING CODE VIOLATIONS AND CONCEALED CONDITIONS
If hidden conditions, structural hazards, improper prior work, concealed damage, or existing code violations are discovered during disassembly, cutting, excavation, or performance of the authorized work, additional work may be required.
If code violations are discovered on components adjacent to or connected to Hopper’s Plumbing’s active work area, or if an inspector requires an existing condition to be upgraded as a condition of approval or inspection, the cost of the additional compliance work is Customer’s responsibility unless specifically included in the original approved scope.
Hopper’s Plumbing is not responsible for identifying every existing code violation in the entire plumbing system or property.
When a concealed or unforeseen condition materially changes the approved scope or price, Hopper’s Plumbing may stop the affected work, notify Customer, document the condition, and issue a written or electronic Change Order through Housecall Pro.
The changed permanent work will not resume until the revised scope and price have been authorized as required.
14. PHOTOGRAPHS, VIDEO AND MEDIA DOCUMENTATION
Customer authorizes Hopper’s Plumbing to photograph, record, or otherwise digitally document the property, plumbing systems, equipment, work areas, and relevant surrounding conditions before, during, and after the work.
Hopper’s Plumbing may retain and use this documentation for estimating verification, job records, manufacturer warranty claims, insurance documentation, internal technician training, trade licensing verification, quality control, dispute resolution, collection documentation, and legal documentation.
Hopper’s Plumbing may also use photographs or videos that do not identify Customer or disclose personal identifying information for advertising, educational, website, social media, or promotional purposes unless Customer notifies Hopper’s Plumbing in writing before work begins that Customer does not authorize marketing use.
15. ESTIMATE VALIDITY AND ACCEPTED PRICING
Estimates are valid for thirty (30) days unless otherwise stated in writing.
When Customer accepts a written flat-rate estimate, the approved price applies to the approved scope.
The approved flat-rate price will not be reduced simply because Hopper’s Plumbing completes the approved scope faster than anticipated and will not be increased simply because the approved work takes longer than anticipated.
A change in price requires a legitimate change in scope, Customer-requested addition or deletion, concealed or unforeseen condition, or another contractually permitted adjustment.
16. MATERIAL PRICE ESCALATION BEFORE MATERIALS ARE ORDERED
Hopper’s Plumbing bases estimates on material and equipment pricing reasonably available at the time the estimate is prepared.
If, after Customer accepts an estimate but before Hopper’s Plumbing orders the affected materials or equipment, a manufacturer increase, supplier increase, tariff, freight increase, supply-chain disruption, or other material cost increase outside Hopper’s Plumbing’s reasonable control materially changes the project cost, Hopper’s Plumbing may issue a revised estimate or Change Order reflecting the increased cost.
Customer must approve the revised price before the affected material is ordered or the revised work proceeds.
Once Hopper’s Plumbing has ordered the affected material based on the approved estimate, ordinary later market price fluctuations will not be passed on to Customer unless another legitimate scope change, substitution, or unforeseen condition applies.
17. PRODUCT SUBSTITUTION
If an originally specified product becomes unavailable, discontinued, backordered for an unreasonable period, or otherwise cannot reasonably be obtained, Hopper’s Plumbing may propose or use an equivalent product of equal or greater quality when appropriate.
If the approved estimate specifically requires a particular manufacturer, model, finish, or product, a material substitution affecting that requirement will be communicated to Customer and approved when appropriate before installation.
18. PAYMENT TERMS
Payment is due immediately upon completion of the authorized work unless written commercial net terms or another written payment arrangement have been specifically approved by Hopper’s Plumbing.
Hopper’s Plumbing does not currently require deposits as a standard company practice.
A deposit or advance payment may be required for a particular project only when specifically stated in the applicable written contract or estimate and approved by Hopper’s Plumbing.
Any deposit required for a California transaction subject to statutory downpayment limitations will comply with applicable California law.
Payments may be made through approved methods, including cash, check, credit card, debit card, ACH, or other payment methods authorized by Hopper’s Plumbing.
Hopper’s Plumbing does not routinely offer consumer payment plans or extended credit.
Acceptance of a late payment or partial payment does not constitute an agreement to extend credit, modify the original due date, waive the remaining balance, or require Hopper’s Plumbing to provide additional or future services.
Hopper’s Plumbing may decline to schedule additional work for a Customer who has an outstanding past-due balance.
19. PAST-DUE INTEREST AND COLLECTION COSTS
Balances remaining unpaid thirty (30) days after the invoice date will accrue interest at 1.5% per month, equivalent to 18% annually, or the maximum lawful rate permitted by California law, whichever is lower.
Customer agrees to pay reasonable and lawful collection costs recoverable under the Agreement or applicable law, including collection agency fees, reasonable attorney fees when recoverable, court costs, and mechanics lien processing costs incurred by Hopper’s Plumbing.
Hopper’s Plumbing’s failure to immediately calculate, invoice, or collect accrued interest does not by itself amend the agreed payment terms or waive the contractual interest provision.
Hopper’s Plumbing may waive accrued interest, fees, or other charges in an individual situation without creating a waiver or precedent for another Customer or account.
20. RETURNED CHECKS, REJECTED ACH AND FAILED PAYMENTS
A check returned for insufficient funds may be assessed a service charge of $25 for the first returned check and $35 for each subsequent returned check from the same Customer to Hopper’s Plumbing, subject to California law.
No returned-check service charge will be imposed when prohibited by applicable law.
Rejected ACH transactions, failed electronic payments, reversed payments, chargebacks, or other failed payment transactions will be restored to the Customer’s outstanding balance.
Any additional processing charge for an ACH or electronic payment failure will be imposed only when permitted by law and appropriately authorized or disclosed.
A returned, reversed, or failed payment does not cancel or erase the underlying invoice or payment obligation.
21. CREDIT CARD AUTHORIZATION
Customer authorizes Hopper’s Plumbing to securely process and, when Customer elects to save payment information through an approved Housecall Pro or merchant interface, securely store the payment method according to the payment processor’s procedures.
A stored payment method does not provide unlimited authority to charge disputed, unexpected, or newly added amounts.
Hopper’s Plumbing may charge approved services, authorized materials, properly disclosed trip or cancellation charges, or other amounts according to the applicable Customer authorization and payment terms.
Full payment card information must not be recorded in ordinary Housecall Pro notes, text messages, emails, or other unsecured communications.
22. MATERIAL STORAGE CHARGES
If a project is delayed by Customer for more than thirty (30) days after large equipment, Customer-specific equipment, or materials have been secured for the project, Hopper’s Plumbing reserves the right to require Customer to accept delivery, arrange appropriate storage, or reimburse reasonable documented storage or handling costs where permitted by the applicable agreement and law.
Large equipment may include water heaters, water softeners, storage tanks, pressure tanks, filtration equipment, reverse osmosis systems, or other Customer-specific equipment.
Any material storage charge must be reasonable, documented, and authorized or otherwise permitted by the controlling agreement and applicable law.
23. ABANDONED OR CUSTOMER-DELAYED PROJECTS
If a project is halted or materially delayed because of lack of Customer communication, failure to provide necessary access, failure to provide required selections, or another Customer-controlled condition for more than thirty (30) consecutive days after materials have been ordered or substantial project preparation has occurred, Hopper’s Plumbing may treat the project as Customer-delayed or abandoned subject to the controlling contract and applicable law.
Hopper’s Plumbing may invoice Customer for authorized labor performed to that date and for Customer-authorized stored, special-order, nonreturnable, or otherwise committed materials to the extent permitted by the agreement and applicable law.
24. CUSTOMER-SUPPLIED FIXTURES AND MATERIALS
Hopper’s Plumbing is not responsible for defects, code incompatibility, incorrect sizing, incorrect finish, discontinued products, missing installation hardware, fitment errors, structural failures, manufacturing defects, shipping damage, missing components, or other deficiencies involving Customer-supplied fixtures, equipment, parts, or materials.
No warranty of any kind is provided by Hopper’s Plumbing on Customer-supplied materials, fixtures, equipment, or products.
Hopper’s Plumbing is not responsible for project delays resulting from Customer-supplied items that are unavailable, damaged, defective, incorrect, incompatible, incomplete, improperly sized, missing hardware, or otherwise unsuitable for installation.
If a Customer-supplied fixture, material, appliance, or component fails, leaks, proves defective, or requires removal or replacement after installation, subsequent diagnostic visits, removal, modification, replacement, or reinstallation labor is billable at Hopper’s Plumbing’s applicable rates unless the problem was directly caused by defective workmanship by Hopper’s Plumbing.
25. CAMERA INSPECTION AND ELECTRONIC LOCATING LIMITATIONS
Sewer camera inspections, line tracking, and electronic locating are diagnostic tools only and may not reveal every defect.
Mud, standing water, grease buildup, debris, pipe scale, damaged piping, inaccessible areas, branches, offsets, poor visibility, or other conditions can prevent complete inspection.
Depth and location estimates produced by electronic locating equipment are approximate and are not surveying-grade measurements.
Hopper’s Plumbing is not responsible for unseen defects, secondary stoppages, hidden branch conditions, or other defects that cannot reasonably be observed with the diagnostic equipment used.
26. REMOVED EQUIPMENT, FIXTURES, PARTS AND SCRAP
Unless Customer specifically requests in writing before physical removal or disposal to retain an old part, section of piping, fixture, valve, water heater, or other removed component, removed plumbing materials and equipment become the property of Hopper’s Plumbing and may be disposed of, recycled, returned for core credit, returned for warranty processing, or scrapped at Hopper’s Plumbing’s discretion.
Hazardous, contaminated, regulated, warranty-return, or manufacturer-controlled materials may be handled according to law, supplier requirements, safety requirements, or manufacturer instructions.
27. MOLD, MOISTURE AND SECONDARY DAMAGE
Hopper’s Plumbing is not responsible for testing, containment, cleanup, drying, demolition, treatment, or professional remediation of mold, mildew, airborne fungi, hidden moisture damage, contaminated building materials, or other environmental conditions outside the immediate authorized plumbing repair unless specifically included in writing.
Customer is responsible for obtaining appropriate remediation, restoration, testing, or environmental services when needed.
28. EMERGENCY AND AFTER-HOURS SERVICE
Hopper’s Plumbing does not advertise, guarantee, or maintain a 24-hour emergency or on-call service.
Hopper’s Plumbing may, at Company discretion and based on availability and safety, accept after-hours work.
Applicable after-hours pricing will be disclosed or authorized before the work proceeds.
Acceptance of an after-hours service call does not create an obligation for Hopper’s Plumbing to provide future emergency or on-call service.
Emergency or after-hours repairs performed under active flooding or other urgent conditions may be temporary diagnostic or protective measures intended to reduce immediate property damage.
A permanent code-compliant solution may require additional scheduled work, additional materials, localized line isolation, or additional charges.
Hopper’s Plumbing is not a first responder. For suspected gas leaks, fire, carbon monoxide, electrical emergencies, violence, or other immediate threats to life or safety, Customer should contact 911, the fire department, the applicable utility, or another appropriate emergency authority.
29. STRUCTURAL AND FINISH DISTURBANCE
Plumbing work may inherently require opening, cutting, drilling, or disturbing walls, ceilings, floors, framing, exterior surfaces, cabinetry areas, or other building finishes in order to access piping or equipment.
Unless specifically listed in the approved scope, cosmetic restoration, drywall repair, texturing, painting, tile repair, flooring repair, structural rebuilding, and other finish restoration are excluded from Hopper’s Plumbing’s services.
30. CODE COMPLIANCE LIMITATION
Hopper’s Plumbing performs authorized plumbing work in accordance with applicable requirements for the specific repair or installation area.
Unless specifically included in the approved scope, Hopper’s Plumbing is not responsible for whole-house or whole-building code upgrades, complete system correction, whole-house venting corrections, total service-line modifications, or correction of unrelated existing code deficiencies.
If an inspector or discovered condition requires additional work outside the original approved scope, the additional work may be addressed through a revised estimate or Change Order.
31. LIMITED EXPRESS WARRANTY POLICY
Hopper’s Plumbing provides a one-year limited workmanship and labor warranty beginning upon substantial completion of the applicable work.
If an operational leak or defect occurs within 365 days of substantial completion and is determined to have resulted from faulty workmanship by Hopper’s Plumbing, Hopper’s Plumbing will correct that workmanship defect at no additional labor charge.
The workmanship warranty is non-transferable and applies to the original Customer unless Hopper’s Plumbing agrees otherwise in writing or applicable law requires otherwise.
A Customer request for a callback or return visit is not automatically a determination that the condition is covered by warranty. Hopper’s Plumbing may inspect, diagnose, document, and review the condition before determining warranty coverage.
Materials, fixtures, appliances, water heaters, pumps, valves, water treatment equipment, and other manufactured products are covered by their respective manufacturer warranties, if any.
Labor to diagnose, remove, return, obtain, transport, process, reinstall, or replace a product or component covered by a manufacturer warranty may be chargeable unless that labor is specifically included in writing by Hopper’s Plumbing or covered by the manufacturer.
The Hopper’s Plumbing workmanship warranty applies only to defects determined to have resulted from workmanship performed by Hopper’s Plumbing.
To the extent permitted by law, the Hopper’s Plumbing workmanship warranty does not cover failures, damage, or conditions caused by circumstances outside Hopper’s Plumbing’s reasonable control, including but not limited to:
• Customer misuse, abuse, neglect, vandalism, improper operation, or improper maintenance
• Flushing or introduction of inappropriate materials, foreign objects, grease, wipes, hygiene products, toys, food, chemicals, or other improper substances into plumbing or drainage systems
• Freezing, extreme temperatures, fire, wildfire, smoke, flooding, storms, lightning, earthquakes, ground movement, shifting soil, landslides, falling trees, or other natural events
• Rodents, insects, birds, animals, or other pests, including chewing, nesting, contamination, physical damage, or disturbance caused by such pests or animals
• Electrical outages, voltage fluctuations, power surges, improper electrical supply, electrical-system defects, or electrical conditions not caused by Hopper’s Plumbing
• Excessive, inadequate, fluctuating, or changing water pressure not caused by Hopper’s Plumbing
• Municipal water-supply changes, well fluctuations, reduced well production, changing groundwater levels, drought, aquifer conditions, sand, sediment, or other source-water changes
• Hard water, mineral accumulation, scale, iron, manganese, sediment, corrosive water, abnormal pH, chlorides, chemicals, abrasive water chemistry, poor water quality, or other naturally occurring or source-water conditions
• Root intrusion, soil movement, deterioration, corrosion, existing structural defects, pipe bellies, offsets, collapsed piping, or other pre-existing plumbing or property conditions
• Normal wear and tear or components reaching the end of their useful service life
• Failure to perform required maintenance, cleaning, flushing, filter replacement, media replacement, salt replenishment, anode maintenance, or other manufacturer-recommended or reasonably necessary maintenance
• Manufacturer defects, product defects, recalls, or failures of materials, fixtures, appliances, equipment, or components manufactured by third parties
• Customer-supplied materials, fixtures, appliances, equipment, or components
• Failures involving plumbing, fixtures, equipment, or components outside the specific area worked on by Hopper’s Plumbing
• Alteration, adjustment, modification, removal, repair, installation, or other work performed after Hopper’s Plumbing’s work by the Customer, property owner, tenant, another contractor, handyman, maintenance provider, or other third party or
• Damage caused by construction, remodeling, landscaping, excavation, roofing, electrical work, pest-control work, appliance installation, or work performed by another trade or third party.
A warranty claim or request for a return visit does not automatically establish that Hopper’s Plumbing’s workmanship caused the reported condition.
Hopper’s Plumbing may inspect, diagnose, photograph, test, and document the reported condition to determine whether the problem is attributable to covered workmanship.
If the reported condition is determined not to be covered by the Hopper’s Plumbing workmanship warranty, applicable diagnostic, dispatch, labor, material, or repair charges may apply when properly disclosed and authorized.
These warranty limitations and exclusions do not apply to the extent a failure or damage is determined to have been caused by defective workmanship performed by Hopper’s Plumbing or to the extent an exclusion or limitation is prohibited by applicable law.
32. SENIOR CITIZEN AND VETERAN DISCOUNT
Hopper’s Plumbing offers an approved Senior Citizen or Veteran Discount of 10% off the eligible invoice, up to a maximum discount of $100 per invoice.
For the Senior Citizen Discount, the qualifying person must be age 65 or older.
For either the Senior Citizen or Veteran Discount, the qualifying individual must be the property owner or the responsible payer for the job.
The discount applies to the invoice as a whole.
The Senior Citizen or Veteran Discount may not be combined with another coupon, promotion, or discount. Only one discount may be applied per invoice.
Hopper’s Plumbing may reasonably verify eligibility when necessary but does not routinely require or retain copies of identification solely for purposes of the discount.
33. HAZARDOUS MATERIALS, ASBESTOS, LEAD AND CONTAMINANTS
Hopper’s Plumbing technicians are not certified hazardous-material abatement specialists.
If Hopper’s Plumbing encounters, disturbs, or reasonably suspects hazardous material, including asbestos-containing material, lead-based material, mold, PCB-containing material, contaminated soil, sewage contamination, biological contamination, chemicals, animal waste, or another hazardous condition during cutting, demolition, excavation, or other work, Hopper’s Plumbing may immediately stop work.
Customer will be notified and the work area may be secured using Hopper’s Plumbing’s limited available resources.
It is Customer’s responsibility and expense to retain an appropriately qualified or certified remediation contractor when required and to obtain appropriate clearance before Hopper’s Plumbing resumes affected work.
Hopper’s Plumbing is not responsible for delays, relocation costs, restoration costs, remediation costs, testing costs, or other losses resulting from hazardous substances or contaminated conditions that were not caused by Hopper’s Plumbing.
34. FORCE MAJEURE AND DELAYS BEYOND CONTROL
Hopper’s Plumbing is not responsible for reasonable delays, water-shutoff extensions, scheduling changes, or inability to perform caused by circumstances outside Hopper’s Plumbing’s reasonable control.
These circumstances may include severe weather, municipal inspection backlogs, supply-chain shortages, manufacturer delays, shipping interruptions, labor strikes, regional utility failures, governmental action, military action, civil unrest, declared emergencies, natural disasters, acts of God, or other unforeseen circumstances beyond Hopper’s Plumbing’s reasonable control.
35. PLUMBING SYSTEM PERFORMANCE DISCLAIMER
Plumbing repairs restore, repair, replace, or improve the specific component or system identified in the approved scope.
Unless specifically stated in writing, Hopper’s Plumbing does not guarantee overall plumbing-system performance, water pressure, drainage performance, water quality, fixture compatibility, well production, or the future condition or performance of unrelated plumbing components.
36. LIMITATION OF LIABILITY
To the fullest extent permitted by California law, Hopper’s Plumbing’s responsibility for claims, losses, or damages arising from a specific job is limited to responsibility legally attributable to Hopper’s Plumbing’s own work.
To the extent permitted by law, the total collective liability of Hopper’s Plumbing arising from the specific job or service giving rise to the claim will not exceed the amount actually paid by Customer to Hopper’s Plumbing for that specific job or service.
To the fullest extent permitted by law, Hopper’s Plumbing is not liable for incidental, indirect, special, or consequential damages, including loss of use, emotional distress, diminished property value, lost profits, rental income, business interruption, relocation costs, hotel expenses, tenant disruption, or personal property losses resulting from conditions outside Hopper’s Plumbing’s reasonable control or outside the approved scope.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
37. INDEMNIFICATION AND THIRD-PARTY CLAIMS
To the fullest extent permitted by law, Customer agrees to indemnify, defend, and hold Hopper’s Plumbing harmless from third-party claims, liabilities, damages, or costs arising from pre-existing property conditions, structural failures, hidden hazardous materials, environmental conditions, Customer-provided information, undisclosed hazards, or Customer or third-party actions outside Hopper’s Plumbing’s control.
This provision does not require Customer to indemnify Hopper’s Plumbing for responsibility that California law does not permit Hopper’s Plumbing to transfer or waive.
38. APPOINTMENT CANCELLATION POLICY
Hopper’s Plumbing maintains a 24-hour scheduling cancellation policy.
An applicable cancellation, rescheduling, dispatch, or trip charge may be imposed when properly disclosed and permitted based on the circumstances of the appointment.
Any statutory cancellation right applicable to a California Home Improvement Contract, qualifying Service and Repair Contract, disaster-related contract, or other legally protected transaction overrides Hopper’s Plumbing’s ordinary scheduling cancellation policy.
39. CALIFORNIA CANCELLATION RIGHTS
Certain California residential contracts carry statutory cancellation rights and require specific written notices and forms.
When applicable, Hopper’s Plumbing will provide Customer with the legally required project-specific cancellation notice and documents.
Depending on the type of contract and circumstances, California law may provide a three-business-day cancellation period, an extended cancellation period for qualifying senior citizens, a longer cancellation period for certain declared-disaster transactions, or different rules applicable to qualifying Service and Repair Contracts.
The project-specific statutory notice provided for the transaction controls over any inconsistent general language in these Terms.
Customer may contact Hopper’s Plumbing at hoppersplumbing@gmail.com or (530) 906-3445 for administrative assistance regarding a cancellation request. Providing administrative assistance does not alter or expand the cancellation rights provided by applicable law.
40. CALIFORNIA MECHANICS LIEN RIGHTS AND REQUIRED NOTICES
NOTICE TO PROPERTY OWNER: Under California Mechanics Lien Law, contractors, subcontractors, laborers, suppliers, and other persons who provide labor, services, equipment, or materials to improve real property may have rights to assert a claim against the property if they are not paid.
Hopper’s Plumbing reserves all mechanics lien, payment, collection, and other remedies available to it under California law for authorized work that remains unpaid.
Any statutory Mechanics Lien Warning, preliminary notice, lien release, Notice to Owner, or other legally required document applicable to a particular project will be provided or handled as required by California law.
Nothing in these general Terms is intended to replace a statutory notice or warning required for a particular transaction.
41. CSLB NOTICE
Hopper’s Plumbing is licensed and regulated by the California Contractors State License Board.
Questions concerning a contractor may be referred to the Contractors State License Board, P.O. Box 26000, Sacramento, California 95826, or to the current CSLB contact information provided in any legally required project-specific contract or notice.
Any exact statutory CSLB notice required for a particular California Home Improvement Contract or other regulated contract will be provided in the project-specific contract as required by law.
42. COLLECTION, OUTSTANDING BALANCES AND FUTURE SERVICE
Customer remains responsible for all authorized unpaid amounts until the account is paid in full or otherwise resolved in writing by Hopper’s Plumbing.
Hopper’s Plumbing may accept partial or late payments toward a delinquent account without agreeing that the late or partial-payment practice is acceptable for future transactions.
Hopper’s Plumbing may refuse to schedule or perform additional work while Customer has an outstanding past-due balance.
A history of significant delinquency, repeated collection efforts, unpaid invoices, payment reversals, chargebacks, or failure to honor agreed payment obligations may result in Hopper’s Plumbing declining future service even after a balance is ultimately paid.
Hopper’s Plumbing may make reasonable exceptions when a documented or credible hardship or unusual circumstance justifies different treatment.
Nothing in this section requires Hopper’s Plumbing to extend credit or provide future services.
43. DISPUTES
If Customer disputes an invoice, authorization, payment, workmanship issue, scope, change order, or other charge, Hopper’s Plumbing may review the signed estimate or contract, approved scope, Terms and Conditions, change orders, invoices, photographs, job notes, communications, payment records, and other relevant documentation before making a determination.
A Customer dispute does not automatically cancel the invoice, establish warranty coverage, or relieve Customer of an undisputed payment obligation.
The parties are encouraged to attempt a good-faith informal resolution before litigation when reasonably practical.
44. GOVERNING LAW AND VENUE
These Terms and all services performed by Hopper’s Plumbing are governed by the laws of the State of California.
To the extent permitted by law, any lawsuit or court proceeding arising from Hopper’s Plumbing’s services will be filed in an appropriate court having jurisdiction in Placer County, California.
Nothing in this section prevents either party from using California small claims court when the dispute falls within that court’s jurisdiction.
45. ASSIGNMENT
Customer may not assign, transfer, or delegate this Agreement or Customer’s contractual rights, duties, payment obligations, or warranty rights to a subsequent property buyer, tenant, or third party without Hopper’s Plumbing’s prior written consent, except where applicable law requires otherwise.
46. SEVERABILITY
If any provision, phrase, sentence, or clause of these Terms and Conditions is determined by a court to be unlawful, invalid, or unenforceable, the remaining provisions will remain in full force and effect to the extent permitted by law.
47. ENTIRE AGREEMENT AND DOCUMENT PRIORITY
These Terms and Conditions, together with the applicable approved estimate, contract, work order, approved line items, written Change Orders, project-specific statutory notices, and final invoice generated through Housecall Pro, constitute the agreement relating to the authorized work.
A lawful project-specific written term controls over a conflicting general term in these Terms when the project-specific term is clearly intended to apply to that transaction.
No technician or employee may verbally waive or materially modify these Terms, add unapproved work, change an approved price, waive payment obligations, promise a refund, or otherwise alter the written agreement beyond that person’s documented Company authority.
By electronically signing or approving the applicable Estimate, Contract, Work Order, Change Order, or other service authorization through Housecall Pro, Customer acknowledges that Customer has received and had an opportunity to review these Terms and Conditions, understands the approved scope and price, and agrees to the applicable Terms governing Hopper’s Plumbing’s services.
